Plain-language summary
Actae's 30-day trial requires a card but creates no charge if you cancel before the displayed trial deadline. You can cancel a paid subscription at any time to stop renewal. For an initial paid purchase, contact us within 14 days and we will generally provide a full refund. Renewals and partially used periods are normally non-refundable, but mandatory law and qualifying service failures always take priority.
1. Merchant of record
Polar Software, Inc. (“Polar”) is the merchant of record and authorized reseller for paid Actae orders. Polar processes payments, taxes, invoices, receipts, and approved refunds. Diviga determines product access and this commercial refund policy, while Polar’s buyer terms and mandatory law also apply to the transaction.
2. Trial
Each founding subscription starts with a 30-day card-backed trial. Polar records a payment method at checkout, but the recurring $149 USD monthly price is not charged until the trial ends. Cancel through Billing before the exact deadline displayed by Polar to avoid the first charge. A later re-subscription or a second account does not create a right to repeated trials.
3. Initial-purchase refund window
You may request a full refund of your first paid Actae subscription order within 14 calendar days of purchase. This commercial promise applies once per customer or organization and may be refused for fraud, abuse, repeated purchase/refund cycles, or a material Terms violation, subject always to mandatory consumer law.
If you are an EEA or UK consumer, you may also have a statutory right to withdraw from a distance contract. Where you expressly request immediate supply of digital content or services and acknowledge loss or limitation of the withdrawal right, the statutory result may differ. Nothing in this Policy limits non-waivable rights, legal remedies for non-conforming digital content or services, or any longer period required by law.
4. Renewals, plan changes, and unused time
Subscription renewals are normally non-refundable once charged because access and reserved service capacity become available for the new period. We do not normally provide prorated refunds for unused time after cancellation, downgrades, inactivity, failure to use included quotas, or removal of an installation.
If an accidental duplicate charge, billing error, unauthorized transaction, or incorrect plan-change charge occurs, contact us promptly. We will investigate and correct confirmed errors. Upgrades, downgrades, credits, and proration follow the amounts disclosed during the plan-change flow.
5. Service failures
If a material defect prevents you from using the paid Service and we cannot correct it within a reasonable time, we may provide a replacement, service credit, partial refund, or full refund appropriate to the impact and applicable law. Planned maintenance, customer infrastructure failures, unsupported configurations, quota enforcement, third-party model/tool failures, and issues in self-hosted environments outside Actae’s control do not automatically qualify.
6. Cancellation is separate from a refund
Canceling schedules the subscription not to renew. Unless it is revoked for cause or a refund decision states otherwise, access continues through the current paid period. A refund of an order does not necessarily cancel its related subscription, so we will also cancel or revoke the subscription where appropriate. You can manage cancellation through Actae account settings or the Polar customer portal.
7. How to request a refund
- Email hello@actae.dev from the address associated with the purchase.
- Include the order or invoice number, purchase date, organization name, and a short reason. Never send full card details.
- We will acknowledge the request and may ask for information reasonably needed to verify the order or diagnose a service issue.
Approved refunds are returned through Polar to the original payment method. Polar automatically handles corresponding tax adjustments. Bank processing times vary; funds commonly take several business days to appear after issuance. Polar may also issue refunds at its discretion for fraud or dispute prevention.
8. Chargebacks
Please contact us before initiating a payment dispute so we can investigate quickly. This does not restrict your right to contact your card issuer or exercise legal rights. Fraudulent or abusive chargebacks may result in suspension while the matter is reviewed.
9. Changes to this Policy
The policy in effect on the order date generally governs that order unless a later version is more favorable to you or mandatory law requires otherwise. Material changes will not retroactively reduce an already-accrued refund right.
